Abstract:
Data about sexual assault cases and the effects of legal and extra-legal factors on defendant outcomes (sentence type and length) were collected. The two legal factors investigated in this paper included presence of an expert witness and defendant relationship to the victim; extra-legal factor of interest was the race of the defendant. The relationship to the victim was correlated with sentence length, whereas race of the defendant was correlated with sentence type (minority race was more likely to see jail time than White defendants). The presence of an expert witness did not have an effect on either sentence type or length. These findings demonstrate the importance of continued research concerning the effects of legal and extra-legal factors on sentencing, specifically in sexual assault cases.
